Alleged Kidnap: Evans Asks Court To Quash Charges Against Him

Suspected kidnapper, Chukwudumeme Onwuamadike, popularly known as Evans has asked a Lagos High Court sitting in the Igbosere area of Lagos Island to quash the two separate charges filed against him by the Lagos State government.

EvansIn one of the charges, the state government filed fresh five counts bordering on conspiracy to kidnap, kidnapping and attempted murder against Evans and three other persons.

The other three are Joseph Ikenna Emeka, Ugochukwu Nwachukwu and Victor Aduba.

In the second charge, Evans is facing trial alongside Joseph Ikenna Emeka, Victor Aduba and Linus Okpara.

At the resumed hearing of the matter on Wednesday, counsel to Evans Olukoya Ogungbeje informed the court that he has a motion on notice to quash the two charges filed against his client.

The lawyer also told the court that the two charges are grossly defective, noting that they constitute an abuse of court process and do not disclose “any prima facie case” against Evans.

He subsequently asked the court to quash the charges and discharge his client.

But the Director of Public Prosecution (DPP) in the state, Ms Titilayo Shitta-Bey, countered by insisting that there were sufficient proof and evidence linking Evans to the charges.

She further urged the court to dismiss the application.

The second defendant, Joseph Emeka, had also filed an application similar to that of Evans but the DPP Lagos asked the court to dismiss same.

Justice Adedayo Akintoye has adjourned ruling on the applications till March 22.
